In April my divorce was final. Judge awarded us joint custody with her final say over medical decisions. My kids are 1 and 3. They attend daycare, every time my kids sneeze wrong she Is taking them to the dr. Then the dr provides some steroid or medicine. They never have time to build their immune system. The newest is my 1 yr old is going for a procedure to see why she is constantly coughing. The kids are fine when they are with me. How do I get the judge to see this is hurting my kids not helping.
You need to consult with a local seasoned family law attorney. You most likely need to retain an expert through your attorney to prove actual harm to your kids.
Your question is complicated but here are a few things to consider. First, is the excessive appointments and medicines actually harming your child and can you get a medical professional to testify to that? Is your ex-wife asking you to split the costs of these visits and causing an undue financial burden? Do you have any reason to believe your ex has an ulterior motive for being so intense about medical care? Seek an attorney who can help answer these questions to better understand if you can and should file for modification.
