Me and girl got into car accident , no critical injuriesbut 3 years later lawyer call us in to office for first time, Says he has good news*_ We get there and he start by telling us our case wasnt woth much and that the insurance of the car that hit the car we was in ( we was inside taxi driver car) has a policy of 15k no more. so we got lucky they offered 20k for me and 12k for my girlsfriend, , this sound okay to me if we just had to give him his cut and thats it... But we also have to pay medical bills from there with its about 12k. he says hes going to fight to bring that medical bill amount down but he cannot tells us how much we will still in pockets, he want me to sign for the 20k and than he could fight to bring that other amount down... why? why cant he settle for us to get 16k each and from there we each giving his % ?
Your medical bills should have been paid by no-fault, which is not lienable. Find out from your lawyer why your medical bills were not paid by no-fault. Also, if your medical bills were not paid by no-fault, then who did pay them and why should they be allowed to get their money back if it was supposed to have been no-fault in the first place. Also, if the policy limit is 15G then why would the insurance company pay one cent more? The minimum is supposed to be 50, not 15.

Something does not sound correct. Taxis in NYC have a $100,000 per person/$300,000 per incident policies.

I agree with the other attorneys and add that there are 2 policies that are in play, the other car and the taxi. The taxi is required to have $100,000. The other car minimum (if New Jersey is $15,000) if New York then $25,000. Check and see why the medical bills were not paid. If you treated after No Fault cut you off you may have a lien which will be paid from the settlement. Also, your recovery is tax free.
