Unmarried in the military (air force) father of 3 yr old boy seeking to get sole custody. Currently stationed in South Carolina with son. Son's mother is in and out of jail due to substance abuse (meth). She is currently in jail for the next 2 yrs or so, charged with possession of meth, intent to distribute, possession of unregistered concealed weapon, evading arrest. Son was taken by the state due to mother's negligence while my fiance was deployed in Turkey. Son was released to the father upon returning to the states in 2015. Legal custody was never or has yet to be presented in regards the above mentioned. Please advice on steps to take to file for sole custody.
Dad needs to file for sole custody. He should get an order pretty easily. What state took son? That is probably the one where he should file, though if he has been in SC for a while, that could also work.
If you don't know how to file for sole custody, getting representation to handle it for you would be prudent
Your best bet is to hire an attorney to help you file for sole custody. It should be fairly uncomplicated if she is in jail. Even with her record it is still tricky so I would have an attorney assist.
