I won a criminal case this past summer in which the defendant pled guilty and agreed to pay me restitution money in the amount of $750. She was charged with embezzlement. Her plea agreement says if she pays me every month until she is done paying me at 100 a month her felony charge will be dropped to a misdemeanor. However, she has stopped paying me. She is 2 months behind. The new district attorney that has come in to power keeps cutting her slack, giving her more time to pay. She says she does not have a job but I know otherwise for she is self-employed and gets paid cash money. i want to file a civil suit against her now. I am tired of all this run around. She is a murder and is getting away with it.I forgot to add, she pet sat for me and used my animals for her exotic animal company she runs and made money off of them, then she killed them afterwards when I caught on and disposed of the bodies.
The restitution order is a judgment already. Have you told the DA about her cash income? If you sue her and she hides the cash you still have a collection problem. You might just be better off sticking with the criminal restitution order.
