Her mother has disappeared. I live with her father we have been taking care soley of her for over 4 months now. I need to enroll her in school. her parents were never married, they have never been to court for custody, and he is not on the birth certificate.
You can order a new copy of the child's birth certificate from the county where she was born. If you have contact with the mother and she is willing to sign an acknowledgment of paternity, you can file that with the state and get a amended birth certificate. If not the father needs to file a complaint to establish paternity and custody. Through this process, he can get legal custody and have his name put on the birth certificate. He may want to do this anyway to protect his rights in the long-run. You should speak with an attorney about your options.
The father needs to file an action for Paternity ASAP. Alternatively, the two of you can file for guardianship of the child. In either case you will need to publish as to the mother if you do not know her whereabouts.
