My soon to be ex wife has a PRO against me, but despite that, Court granted me Visitation. I drove over 300 miles to pickup our Children for Christmas, however, she denied Visitation.
The real reason she filed false DV, got me arrested, won a Restraining Order, was so she can move as far away from me with our Children. I am in a relationship with someone whom I live with, and my ex hates. All of this is in retaliation - and I am on the losing end. I work hard, but can barely afford my own Rent & Utilities and I'm going into Debt with plans to file Bankruptcy. It seems more than 3/4 of my income goes to Child Support and Alimony. All the while, I have only seen my Children twice in the past 4 months.
How do I convince the Judge to make my ex move back closer so that I can have more time with my children?
You can certainly get some traction with her denial of visitation but the best result possible is that you would get custody of the children (unlikely) - but the judge cannot order her to move back to CA.
