Hello, I currently live in CA as well as my ex but when we filed for divorce we lived in CO. I lived in CA when it was final. I would like to change back to my maiden name now since it was not done in the divorce. My question is where do I file papers to change my name, CA, where i currently live or CO, where I lived when the divorce was filed?ok so I file in Kern County. In the box where it asks for the address of the court, instructions say to put the court that the divorce was filed in. Do I still put the CO court on the CA form or use a Kern County court address?
You need to file for a name change in Kern County or see if your name was restored in the CO case.
No attorney/client relationship is or shall be created by this response on Avvo to non-clients of The Law Offices of Norman Gregory Fernandez.
You can make the name change request in the county where you currently reside (in California). As for how to make the request, the process is different, depending on whether your divorce case was transferred to CA (because you said it was pending when you and your ex moved here) and finalized here, or if it was finalized in CO.
You'll find the instructions under both scenarios here: http://www.courts.ca.gov/1051.htm#div
