I am in Elko County and do not have access to the legal resources in Clark County. Last week I filed a complaint for divorce but since then my husband and I have been speaking and decided that a legal separation would be better for us. He has not been served yet. I have no reason to believe I cannot amend the divorce, however I have been unable to find any forms or wording to do so. If one can amend a separation to change it to divorce, shouldn't one be able to do the opposite? Any help in this regard would be appreciated.
The easiest fix might be to have your husband file an Answer and Counterclaim for separate maintenance. You can then Reply to his Counterclaim. I do recommend that you speak with a family law attorney regardless to make sure that you understand what a legal separation in Nevada means, and its effect.
