My husband entered the US in 1998 without a visa so he is in the us illegally. He plead guilty to a 4th misdemeanor driving under revocation and a misdemeanor DUI he is currently in the county jail and ICE has put a hold on him. We have been married 6 years and we are currently in processes if trying to get his legal status corrected. We have all applications in and got a letter saying they have accepted his application. Can they still make my husband leave back to Mexico? I am very ill and we are in a state of panic because we have 2 children together and I have another 2 from a previous marriage and my son has seizures and we are not able to go to Mexico with him. Please help.

They will not remove the ICE hold. You need to have an attorney see if your husband qualifies for immigration bond and/or any type of immigration relief. You aren't going to be able to do this without an attorney, so either hire one or if you cannot afford one try to find one to do it pro bono. My firm handles deportation defense throughout the US.
