1 year restraining order set to expire 12/31/2019. In feb 2019 I moved from alemeda to San Joaquin. We have had zero contact. I only found out about the attempted extension Thursday night when i was stoped by police for a taillight our. He told me their was no active order but there was a petition that had not been served. I called the clerk and found out about the petition and there was a hearing on Jan.3. That was continued for no service of process. Petitioner doesn’t know where I
Live or work.
There is a relatively low standard for extending a restraining order that has already been granted. The fact that youve not had contact with the individual since the restraining order was granted or that the protected party doesnt know where you live is not a bar to that person obtaining an extension on the restraining order. You maybe to prevent an extension, certainly you have a right to a hearing on the matter. All the best luck with this.
