The faribault co Mn attorney tried to use a 3/27/2017 Mc D,s Video for a crime he made-up for 3/30/2017. We have been asking for a copy of the video since. 4th hearing about the video co attorney say,s Mc D, destoryed the video. Public defender just sat there. so I stand up and tell the there never was a video of me in McD,s on 3/30/2017. The judge yells at me saying that my lawyer is asking to have me commited. My lawyer told me he could get the case dimissed if I would wave my right to a jury trail at hearing before.
Too many questions here. The judge can order the assessment if the judge determines there are grounds to support it. Without knowing more facts the rest would just be speculation...
Rule 20 of the MN Rules of Criminal Procedure states, in part "If the prosecutor, defense counsel, or the court, at any time, doubts the defendant's competency, the prosecutor or defense counsel must make a motion challenging competency, or the court on its initiative must raise the issue. The defendant's consent is not required."
