My ex and I will soon have 2 kids together he was staying with me for about 4 month of our first child life but wasn't any help i put him out because of none stop smoking, verbal and physical abuse from him he won't quit smoking to get a job and says that he's not going to quit cause I asked him to. He does help with anything he doesn't call text or come over anymore because I won't let him take our child with him so he does want any dealing with us he says his moving out of state is there anything I can do to take his rights away there's no point in child support since he doesn't have a job
If you are wanting to file abandonment charges in the criminal sense, likely no. In the family law sense, if he has left, is not creating issues, and is not providing support, you could eventually pursue a Petition to terminate his parental rights. Typically, this is done at the same time as an adoption, but you could pursue this now, if you elected to do so.
