The estate received the annuity in 2016 but the executor did not distribute the money until 2017. I am being asked to amend my 2016 taxes (I have already received my tax return) to include what I inherited from this annuity but I do not think it is fair since I did not get the money until 2017. Also, I gave my church 1/3 of my inheritance in January (2017) which would help me offset my tax obligation but I can not use it since the tax years are off.
More likely than not, the estate is correct. Estates are allowed to treat distributions made 45 days after its year end as if the distribution were made in the earlier year.
