I paid a ~ $1250 medical bill and was told that I would receive a receipt by mail. When the receipt did not arrive I called the company that handles the Hospital's medical billing and asked that they resend it. They said they would, however nothing arrived. I called about 20 times over the course of 3 months begging for an invoice and provided a fax number so that they could expedite the request and nothing was sent. The deadline has passed for my insurance company to reimburse me for this expense. Can I sue for a copy of the itemized payment statement and for monetary damages?
Probably. You should consider filing in small claims for this type of damage. You need to sue the facility in the jurisdiction where it is located. On line you can also find how to determine the individually who is the agent for service of process of the facility. That is who you will actually have the small claims claim served once you get a date of hearing. Get your documents together to prove your attempts to get a receipt. Good luck!
