I will appreciate an answer regarding my matter, i delivered in painful and cruel natural delivery because i refused to a c section that was not necessarily in my situation, since i stand on my own at the time of the delivery i got horrible horrible treatment by midwife which admit after the delivery that i ask for it and this is what i deserve,
Right now i am suffering from fiscal pains as a result of this birth, but specially i feel Aggravation and mental pain from an occasion that was supposed to be one of the best in life, i cant do anything accept of crying and ask myself why i deserved this attitude??
I am interesting in a lower how deal with those situations, i will appreciate a reply
What do you feel was done to you that was below the standard of care. Aggravation and mental pain is generally not enough to proceed with a claim for medical malpractice, assuming the treatment you received was below the standard of care

However, in order to prevail in a medical malpractice action you would need to be able to prove that the medical treatment provided did not meet the standard of care. Also, the non physical problems you are experiencing, aggravation and mental pain, would not be enough for a medical malpractice action. I sympathize with you, however, unfortunately the medical malpractice laws do not encompass what you described. The medical lobby for years has been painting attorneys as these money grabbers that only care about how much money they can make, when in reality it is the low performance of medical professionals that opens the door to so many lawsuits. In your case, for example, it will be almost impossible to find a medical professional that would certify that the treatment you received was below standards.
