Hi, I need some advice I have a court date for Tuesday 16 that the police gave me, but I don't get any letter of the court and neither is my name on the court calendar. What should I do? go with the ticket gave me the police in the right date? and where I have to address? Why my name is not in the court calendar?
Go to court on the 16th. Most courts have electronic boards that list all cases on calendar that day. If your name is not in the calendar, head to the criminal clerk's office to see if there has been a filing on your case. You may also need to go to the DA's office and get an update as to why no filing has occurred.
Many times, the DAs office does not filed by your appearance date on the citation. You should still go to court because sometimes they do file last minute. Check the display screens to see if your name is on the counter. If you do not see your name, go to the DAs office to verify charges have not yet been filed, get something stamp with the date and time to prove you were there.
Or (since you will need one anyway) why not look for a good, local criminal defense attorney to represent you? Your attorney can go to court (either on the 16th or whenever charges are eventually file) to present you without you having to be there.
The above answer is for general information only and is based on the information you posted. Every case is fact dependent, so to get a thorough analysis of your situation, you will need to consult face to face with an attorney licensed to practice in the jurisdiction where the incident took place. Do not conclusively rely on any information posted online when deciding what to do about your case.
Never miss a court date! District Attorney's often file charges at the last minute. If you are not on that days calendar the court will inform you that there is a no complaint for that day. You should than watch for mail with a new court date and call or go to the criminal clerks department and ask for an updated status. The DA can also give you and updated status if you call them. Good luck. Hope these answers help you?
Your name may not yet be on the court calendar, though it certainly could be on Dec. 16. You should definitely appear on that day, or send an attorney to appear in your place. Make sure that you search all your possible names, as well as the booking number and CDL numbers just to be completely sure you do not miss your court date. Also, bring the citation, or provide to your attorney to present to the clerk and the DA to see if any information is available. Good luck.
Whether or not your name is on the court calendar, you should still go to court on the date that it says on your ticket. I would recommend appearing on that day or sending an attorney in your place.
