Hemet CA (Riverside County) can i legally evict current tenants using owners move in eviction ?
We are working with the sellers on this issue now so we are only asking the above question as worse case scenario.

You are buying the house subject to the existing lease. Consequently, unless the lease has some unusual language, you would have no right to evict until the lease expires.
Even then, your right to evict may be limited by any applicable eviction control law and/or eviction moratorium law.
Your best option may be to try to negotiate a buyout of the tenancy (i.e. paying the tenants to leave early).
Or, if the seller promised to deliver the property vacant, you may have grounds to rescind your purchase.

You should also make sure that you have adequate and appropriate insurance in place (which would normally be a landlord policy - not a homeowner's policy), since eviction efforts can trigger tenant lawsuits.
