The judgement is dated October 1 2009 is there a statue of limitations on this? Its not on my credit report , just found its against my house when im refinancing. Also am i able to setlle on this still even tho it so old and an attorney office has it?
A money judgment is good for 20 years. You can try and settle.
I am a former federal and State prosecutor and have been handling criminal defense and personal injury cases for over 22 years. The above answer, and any follow up comments or emails, is for informational purposes only and not meant as legal advice.
The judgment is a lien against your real property for 10 years from the date of entry. It is enforceable for 20 years from the date of entry. You are free to call the creditors attorney and attempt to work out a settlement amount. Keep in mind that New York interest is 9% simple interest per year. In other words the judgment that was entered it is now almost twice as much as it was the date it was entered. Most creditors have standard settlement practices.
I wish you the best.
