Hello my name is Summer Hall I am 20 years old and currently a sophomore in college. This past weekend I got an MIP plus lying to the officer about my age, I tried making up some story about how my passport says I am 21 and my ID is all wrong. I got a misdemeanor last December for 4th degree assault, but was told my case would be dismissed once I paid the fee which I did! I am just wondering what is going to happen when i go into my court date on Wednesday.
I would highly recommend that you talk with your parents about helping you hire an attorney, especially because you are in college presumably trying to jump start a career down the road.
Each charge is punishable by a year in jail and a $5,000 fine. You want to know the outcome, but that is impossible to predict. Your attorney may be able to negotiate some sort of plea deal where the prosecutor will dismiss one if you plead to the other. You will almost certainly have to do an alcohol/drug evaluation and take some classes about underage drinking. By the way, if you end up convicted of either charge, that will most likely revoke your deferred sentence on the assault in the fourth degree from December. Since you're twenty, "juvenile" is not the correct practice area (you are not a juvenile).
don't use your name on public forums like this, or give specific information- details of your matter online. You need an attorney. Contact one today. I live in Moses Lake Washington and travel throughout Eastern Washington. If you cannot find an attorney in your local area. Good luck
It's unlikely a prosecutor would read avvo to get intelligence on people, but you never know. Best bet is always to say nothing unless you are talking to your own attorney. So go hire the best one you can afford.
