Hello I was playing basketball at veterans park in culver city when I crashed into the steel pole and injured my back ,the pole was not padded as I should have been, I want to know if I can file a claim against the park.
Reclassifying to personal injury. Many outdoor park basketball courts have metal poles. As far as I know, there is no code nor other requirement that the poles be padded. Anybody can file a claim. The question is whether or not the claim will be successful. I do not think this claim could be successfully fought, and if asked, I would not take this case. Please know, though, that to pursue a case against a governmental entity for a dangerous condition of government property, you must file a claim within 6 months of the injury.
I have never heard any premises expert say a public park basketball pole should be padded. Anyone can make a claim but I see two major issues of: 1) how was park negligent; 2) how was the alleged negligence NOT open and obvious to you before you voluntarily chose to play basketball next to it.
