WE HAVE BEEN GOING TO THIS TOTE YOUR NOTE LOT FOR YEARS. LAST MONTH MY HUSBAND TRADED A CAR HE GOT FROM THEM FOR ANOTHER ONE, WHILE DOING THE PAPER WORK THE SALESMAN SAID ANOTHER CUSTOMER CAME IN WITH THE DOWN PAYMENT FOR THE CAR MY HUSBAND WANTED, SO MY HUSBAND CHOOSE ANOTHER CAR. WELL ALMOST 2 DAYS LATER THE SALESMAN CALLED AND SAID WE HAVE TO BRING THAT CAR BACK CAUSE THEY COULD NOT GET THE TITLE, SO WE SAID OK WE WILL JUST GET OUT CAR BACK, WELL NO THE HAD ALREADY SOLD IT TO THE AUCTION. SO MY HUSBAND ASKED THEM TO FINE THE CAR HE WANTED (IM SURE HE DIDNT LOOK). A COUPLE OF DAYS LATER THE SALEMAN CALLED AND SAID HE HAD SOMETHING FOR MY HUSBAND. WELL MY HUSBAND GOT THE CAR AND STILL HAD TO PAY$1100 DOWN BUT COULD BRING IT BACK. A COUPLE DAYS AND I FINALLY RODE IN THE CAR AND IT NEEDED WORK, THEY HAD NOT CHECKED IT OUT. SO WE CALLED AND THEYSAID THEY WILL PUT IT IN THE SHOP. WELL AFTER 2 WEEKS MY HUSBAND HAD TO CALL AND CHECK ON THE CAR, THE SALESMAN HAD NO IDEA WE WERE STLL WAITING. WE WERE TOLD THE HAD TO ORDER PARTS AND WERE WAITING FOR THEM TO COME IN, THAT WAS THURSDAY, WELL FRIDAY WE GOT A CALL TO COME PICK IT UP. WELL THE BATTERY WAS DEAD AND FOR A CAR TO BE JUST BROUGHT BACK, THATS NOT POSSIBLE. SO MY HUSBAND GOT THE CAR AND TOLD THE SALESMAN HE WOULD BRING BACK THE $1000. AFTER SEVERAL MORE DISCUSSION ABOUT WETHER HE SHOULD KEEP THE CAR DUE TO IT MAY NOT BE FIXED AND IT WAS WAY TOO MUCH FOR THE CAR. WE TOOK IT BACK. WE ASKED WHAT COULD BE DONE ABOUT GIVING THE MONEY BACK, DURING THE FIRST 2 MINUTES OF US TALKING WITH THE SALESMAN THE OWNER WAS STANDING IN THE DOOR BUT OF COURSE HE LEFT. WELL WE TALKED WIHT THE SALESMAN FOR ABOUT 10 MINS( WE HAVE BEEN DEALING WITH HIM SINCE OUR FIRST CAR PURCHASE IN 2004). HE WENT TO ASK IF WE COULD GET OUR ONEY BACK. OF COURSE I TOLD MY HUSBAND THE OWNER WAS NOT GOING TO DO IT, AND SURE ENOUGH THE SALESMAN CAME BACK WITH A HOTHEAD AND SAID WELL JUST LEAVE THE KEYS, SEEMS LIKE YOU ALREADY MADE UP YOUR MIND YOU TOOK THE OTHER CAR OFF THE INSURANCE, NOW I ALSO HAVE A CAR FROM THEM SO YES WE HAVE 2 CARS FROM THEM BUT I WENT TO ANOTHER DEALERSHIP AND PURCHASED A CAR EALIER IN THE MONTH SO I TOOK MY CAR OFF THE INSURANCE BUT THAT CAR HAD NOTHING TO DO WIHT THE ONE MY HUSBAND HAS, AS I TOLD THE SALESMAN. MY HUSBANDS CAR WAS ON THE INSURANCE.. SO LONG STORY SHORT WE DID LEAVE MY HUSBANDS CAR THERE. I PAID THE CAR NOTE ON THE CAR I ALREADY HAD WITH TEHM AND MY HUSBAND LEFT WITH NOTHING, NO CAR, NO MONEY FOR HIS TRADE AND NO APOLOGIES. IS THERE SOMETHING WE CAN DO?
Sounds like the dealer did not treat you right. You need to write a letter by certified mail to set out the facts, and to demand what you consider to be a fair result. The dealer definitely owes you top dollar for your old car, and needs to make this right. If the dealer fails to do so, you should consider filing suit in small claims court to recover the money that the dealer owes you. You can use the certified letter as evidence in your suit.

Any time you start the question with "Do I need a lawyer" the answer is yes. You have already attempted to deal with them and have no satisfaction. They currently have your car, your title, and your money. Unless you want to just leave it with them, then contact a lawyer ASAP.
