Hi, I have an urgent situation and need some urgent advice. I am currently working on h1-b and have a pending EB2 I-485 AOS. My EAD/AP card is approved and should arrive in few days, and my GC interview is scheduled for May 9th.
I plan to go back home, get married, come back before my interview and file Follow To Join I-824 for my spouse. I am not going for h-4 stamping as I don't think I will have enough time to do that.
My question is, do I need to file Follow to Join for my spouse before my I-485 petition is approved or can I also file it afterward I-485 is approved. I have consulted two lawyers, but got opposing answers. One said it can be filed after and the other said, it has to be filed before.
Does anyone here has any experience regarding this situation.
Any feedback would be very much appreciated.
