I am a H1B visa holder and my wife is a H4 visa holder. In the future, if my employer decides to file my I-140 EB3 petition in order to become a green card holder, will my wife be also included in the change of status request? Will she be included as Dependant and be able to go from H4 to green card?
She can file an adjustment of status application if she is currently in the U.S. in valid, unexpired lawful nonimmigrant status and otherwise admissible to the U.S. Consult with a lawyer for assistance. Good luck!
