My H1B visa was valid till July 19 2020(6 years on H1b petition will get over by July 19 2020 ) buy my Employer terminated my employment on Feb 15 2019 and gave me 60 days to get status changed. I applied for Change of Status (COS) from H1b to H4 (as i didn't find any job) on April 12 2019. On April 15 2019, an employer showed interest in my profile. So question is - will it be new h1b in non cap or h1b transfer (my previous employer might have revoked my h1b petition and 60 days starting Feb 15 2019 is over by yesterday April 15) ?
It will be a new non-cap petition. Since you're beyond your 60 day grace period, it will not be a transfer and you need to leave the US, get a visa stamp and return.
Ask the new employer to use premium processing, so that you can return to the US more quickly.
