My company filed a pure H1B Amendment for me with no extension for location and client change. I have to file for H1B Extension now and get it processed in premium processing once the premium processing is open again in Feb 2019 to avail the opportunity to get the h4 EAD for my wife before it is cancelled. If the H1B Amedment is still pending while I try to convert my extension in premium processing, will it be a problem? As per the company's attorney, Amendment needs to be adjudicated first and then extension can be premium processed. However, he did not say anything about the option of withdrawing the Amendment while filing the extension. Please advice.
Extension will not be premium processed without a decision on the amendment.
