I know its worth more$.. Am I being discriminated?
Your post lacks necessary detail, however, if you are a nonexempt employee, you must be provided with a duty free unpaid meal break of at least 30 minutes if you work 5 hours or longer unless you signed a meal waiver and do not work more than 6 hours in the company "workday." If you do not have the opportunity to take a meal period as the law requires, your employer owes you one hour of pay as a meal violation penalty. If you are paid for the meal period and are not duty free, your employer still owes you the meal violation penalty.
Unless you are in a union job that has negotiated premium pay for certain shifts, your employer is only legally required to pay you minimum wage for any hours that you work. If you are required to take a working lunch, the employer is required to pay you an hour of additional time to do so. You are not entitled to more than that.
You suggest discrimination. However unlawful discrimination only occurs when you are being treated differently because you are a member of a protected class of people. Simply being paid very little without an unlawful motive will not allow you to sustain a claim of unlawful discrimination.
Good luck to you.
