I was tricked into signing a contract at a gym. The sales showed me the contract on his ipad and i carefully looked at it and signed it. He states there will be a copy send to my email. after 1 day I receive no email so I ask if they can just print it out. The one that printed out is totally different from the one I signed. I went back a day later asked them why is it different and whats going on but the sales just keep telling me they will inform their 'corporate' about this. I went talked to them again after the weekend in person the sales then call the cops saying im harassing them and if I don't leave they will kick my ass. I told them Im a member here why would I leave then they say my membership has cancelled already. Ive never received any cancellation noticed. it is all verbally said by the sales. they already charged my credit card for a down payment. what should I do now? If I want to sue them how much will it cost? thx.
Depending on the amount and term length of the contract you may consider filing a case in the small claims court where the gym is located. The Michigan small claims process is relatively straightforward. The filing fee is about $20 normally. If they remove the case to District court, which they will have the right to do to have an attorney represent them, you could also hire an attorney. Attorneys are not permitted in small claims court.
