Either the 2 year or years going back for not paid overtime calculation: does it start going back from the date you filed a lawsuit to claim unpaid overtime? Or, from what date?
Example if stopped working on April 1st, 2016 and not yet filed a claim with employer, nor filed a lawsuit : does the 2 years start back from the date you will file lawsuit?
The look-back period will begin on the date you file a lawsuit. If the FLSA violation is made knowingly then the look-back period is three years instead of two.
