In a civil trial where there are allegations of Fraud/forgery by Defendant D1 against plaintiff P1. The trial is pending and awaiting ruling. But there is another lower court case where P1 is involved in another party X1. In this lower court trial, D1 is called as witness to the forgery (not as a party or defendant but as a witness as he was involved in the forgery and given discovery answers admitting committing the forgery/fraud in the higher court documents). So if the D1 gives a witness testimony where he admits to the fraud and also other investigators of the crime were asked to testify are admitting/proving the fraud/forgery, what happens to the main/higher court case? Will it be cancelled since the defendant admits the crime/fraud in the lower court?
Some may claim res judicata, but the lower court case is not between the P1 and D1 but between P1 and X1 where D1 is called as a witness where he is forced to admit his fraud in Higher court case. Hope you all got this.
My question is if the D1 in higher court/case admits his fraud/forgery in the lower court Trial as a WITNESS, will the main court case will be decided against him besides his lower crt trouble?
