I have 4 children with my ex wife. She had an affair during our marriage and got pregnant. She told me the child wasn't mine and put the other man on the birth certificate. We were still legally married at the time. I beleived her and have never seen this child until recently. After seeing him, I got a paternity test and found out he is my child. I do have a lawyer and we are in the process of establishing visitation/custody. I am wondering if there is any legal recourse for her basically lying and keeping my child from me for 5 years. She does admit to knowing after the child was born. I know it's not a crime (it should be) but is there any civil action I can take?
Speak to your attorney. My advice is keep focused on the true goal, visitation and custody now. And more importantly building a relationship with that child. Good luck.
