Received I 130 notice of action. This was filed through on line at Photomac Centre. Arlington. But Form I 485 , I 693 , Affidavit of support, Vaccination report and other required documents were submitted to USCIS FBAS, Chicago.Both were submitted in different immigration centres. I received I 130 notice of action. But I didnot receive any message from Chicago centre. How much time it takes to get the receipt. In case it delayed further, Can I leave USA to India without having AP. How much time it takes to get AP.
In case I leave USA will my B2 visa will be valid for further journey to USA.
There was no reason to file part of the case one way and the other part a different way. Why in the world didn’t you just file the entire case by? What advantage do you seek filing this way?
If you leave without AP the case is abandoned and you cannot come back until everything but the I 130 is refiled through consular processing which will take six months or more after the I-130 is approved.
You may want to consult with a Board Certified Immigration attorney before this situation gets much worse.
USCIS retains the right to choose the application center where your application will be adjudicated. There was no reason to file your applications the way you did. No, you cannot leave the country while your AP is pending. Consider a consultation with an experienced immigration attorney who can properly review your case.
