But they then said I was to late and a wage garnishment is now in place how do I stop this now ?? Hardship I really need some help with this ? Thanks
Probably the only way to stop the garnishment is to file a petition for relief under the bankruptcy code. If you make an offer to settle the matter, the SBA will require a sworn to financial statement, a hardship letter, and as many as a dozen or more other items to consider. Since the SBA apparently has a judgment, it is doubtful that a settlement can be reached before the garnishment starts.
You should call around 1st thing Monday morning and make an appointment with an experienced bankruptcy attorney that handles chapter 7 and chapter 13 cases and handles debt collection matters for the borrower / consumer. Most bankruptcy attorneys will meet with you at no charge for the initial appointment. You can use the Avvo "Find a Lawyer" link at the top of this page to search for an attorney.

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
