For the past 4 years, I have been dealing with a physical and mental disability. My doctors and I could not pinpoint it through testing. The only thing we could confirm was that I had an auto immune disease from blood tests. My doctor filled out FMLA paperwork for 3 years in a row for my workplace. I had a few reasonable accommodations set up. I receive excellent job performance and attendance reviews. I barely used any FMLA time. A month ago, my doctors were able to diagnose me with 3 specific mental disorders, and 2 physical disorders. All of these developed after a few years employment. My new FMLA paperwork reflects this. With my mental disorder, I have trouble working with my boss. She is very difficult - she is extremely passive aggressive. She has been bad mouthing me to HR for months. She sets up unreal expectations for me. I have wrote her 20 emails saying I need clarification on duties, and am uncomfortable with the way she has me set up to work. She ignores the emails. I tried talking to her numerous times, her boss, and HR. I asked for a transfer. Nothing was done. My doctors note says I specifically need clear expectations/directions. How can I fight this?
I would contact a lawyer who handles FMLA and ADA claims. FMLA is primarily concerned with missing time from work, being late, etc... as a result of a medical condition. However, you may have an ADA issue as well.
