i have a felony for burgulary i got 6-9 months intense but my probation officer violate3d me on technicals for none payment i have only paid 1 month and only compkested 1/2 of my community service biut i have only been out of prison for 4 months and i just gort a job. how long do you think i will get on this violation. i have to turn my self in tonight
Really hard to say. Generally, so long as you have been compliant in all other areas and showing good efforts to make good on those other conditions, the judge will take notice of those things. If it is not your first revocation, that would be a different story. Make sure you have proof that you have been searching for jobs and ensure that the court knows that you have not violated in any other way. With the right argument, the judge should give you more time to become compliant. Need to make sure you have an explanation for the lack of community service work as well.
On techical violations you can only be revoked for two years. However, if your only violation is nonpayment, the court has to make a finding that you were unable to satify that condition because of money issues. If the court told you in sentencing you could do community service for your fine, that argument will not get you very far. I cannot predict what the judge will do otherwise.
