If the Court has erroneously inserted untrue depictions (never uttered during trial) and not affecting amount of CS, will the Court consider a re-write?
How can the court legally make a child support ruling, while ignoring demand for Respondents missing filed tax returns? Allowing Respondent not be punished for production of phony tax returns… is this abuse just NY, or nation wide?!?
The fundamental failure of Congress in eliminating national welfare is that they piped a basic administrative function -- paying for a kid -- through a court system not suited for such a task. Courts run under complex rules which can be defeated, maligned, twisted or ignored depending on the litigants. The child support respondent who is a billionaire can hide any evidence of his income and default into a low, contrived amount in support. In your case, if you are the custodial mother, you realize this system is driving you to file 'objections' to the support magistrate's order. THat is a run-around if ever I knew one.
This system is national in scope although it is tailored to some extent in each state to give the appearance that child support is a state function. It is not.
Possibly - you'd need to file a motion to renew/reargue, which should generally be filed within 30 days of receipt of the decision. As for disclosure, again, you must make a proper demand for same, and then if same if not replied to, you must filed a motion to compel disclosure, while attaching your original demand & affidavit of service. That's the only technical way to get a ruling. Schedule a consult with a NYC Family Law attorney for a full assessment.
