Hi, I am from India. I am an applicant for F4 Green Card lottery & my priority date which is 08/22/2002 became CURRENT this month. I got in touch with my petitioner who said that she has paid the $88 fee however did not fill DS-261 to "Choose an Agent". Would that affect my case? Because I received a letter from NVC saying that it will not process my case until I fill that form. How soon shall we fill that form? In other words, I just want to make sure that I don't get disqualified after waiting for 13 years so I want to know till how long can my petitioner wait before filling DS-261.I want to know that I am still eligible under this program even if the priority date has become current and I have not filed DS-261 yet which I am going to get done within next week.
There must be a responsible person to correspond with the NVC and complete the process. The sooner the better.

In this case, you should choose someone, who understands the process; file Form DS-261 ASAP; and let the immigrant visa process begin. NVC will then send out the required invoices. Once the invoices are resolved, NVC will expect the relevant immigrant visa applications to be filed.
