I am currently on F1-OPT status and it expires June 2020. I am planning to apply for H4 and H4-EAD by end of January considering the current processing times (5-7 months).
• What happens if H4 EAD revoke rule gets published in March 2020 (as per their current agenda) how would USCIS deal with pending applications? Will they process the application based on the effective rule at the time of submission or is it upto their discretion?
USCIS will continue to process pending H4 EAD applications filed before revocation of the rule. You might also consider a H1B cap employer sponsorship.
