estate is in MA and I am trying to determine what is a reasonable fee for me to pay myself for being executor, if I choose to do so. Also wondering what the going rate for an attorney to be an executor is it hourly vs % of estate??? This information will help be make a better determination. Thank you
Since the estate is in MA, you need to consult a MA estate attorney for a correct answer. There are fees for "ordinary" work and fees for "extraordinary" work - for both executor and attorney.
Some states, like Washington, do not permit billing fees as a percentage of the estate. Logistically, having someone in MA handling the probate will likely be the most cost effective and less stressful for you. Check AVVO attorney listing for a qualified probate attorney in MA. As for the Executor fee, a rate of $20 to $25 would seem reasonable. Make sure the will permits the Executor to be paid. Good luck.
I think you'll get a more accurate answer if you re-post your question, but this time list your location as the town in Massachusetts where the probate will need to happen. That way, your question will come to the attention of lawyers licensed in Massachusetts.
All the best!
