Kindly find the following scenario : a person on a b2 visa receives an employment offer from a university/ educational institution. This is the first time ever this person is in the USA. What are the chances of success when the cap exempt employer petitions for a visa for the prospective employee? The prospective employee has never before applied for a work /h1b visa in the USA
If the job offered is one that requires at least a bachelor's degree and the person has the bachelor's degree, it should be accepted. I am slightly concerned with the B2 status. I may recommend consulate processing for the H1B, but need to know more facts. Good luck.

The issuance by USCIS of a cap exempt H-1B will depend on whether you and the petitioning employer can fulfill all of the requirements for H-1B eligibility. You should contact the employer’s immigration attorney to discuss the details to determine your eligibility.
