It is very rare for the EEOC to actually investigate a claim anymore. Generally they may make a light attempt to settle the case or set up a mediation. If this fails, they tend to merely issue a right to sue letter which allows you to proceed on to Federal Court.
One option you may want to consider would be filing with the New York State Division of Human Rights as their agency will potentially offer you a hearing where an administrative law judge could decide your case.
Both of these agencies deal with discrimination in the workplace.
