I was considering filing a motion at the clerks office for an early termination of a dui probation which i have met all the terms and am half way though, but i was wondering what would be my chances of success,also am not sure how to go about with motion to terminate probation and expunge the case, are they filed at once?any advice highly appreciated.
It is a good idea to file it. The worst the court can say is "NO" and it only costs you about $150 to take the chance. Best case they say "YES" and you terminate your probation early.
Make sure you fill out both the 1203.3 and 1203.4 paperwork (one is for early term of probation, the other is for expungement). This way, if the court DOES grant your 1203.3 early termination, they can then also expunge your case under 1203.4 which will result in the case being dismissed from your record and most of your rights restored.
