what is the risk if i dont get my EAD by Jan-19 ?
You obviously have an immigration attorney so why not ask him/her? Doesn't he/she know the answer to this simple question? If not you need a new attorney.
You and your employer either extend the L-1A status if you have not reached the statutory time limit and/or provide a comprehensive response to the RFE to allow the issuance of the EAD by January 8, 2019.
You, your employer and your lawyer have no other alternative under the circumstances than to timely apply for the renewal/extension of your L-1A status, as well as vigorously (and completely) answer that RFE in order to allow your I-485 to proceed unhindered. That of course assumed you have not yet reached the statutory max period for L-1A stay.
