I was on the way to my mom’s house in a different city when I hit a curb on the way there and my tire started to gradually deflate. Realizing it wasn’t flat all the way I tried to hurry home before it was completely flat. But I didn’t make it and was forced to pull over on the side of the road and turn my flashers on. Got on the phone with road side and waited for them to come and fix my car or tow it, when cops showed up and pulled up behind me and turned in their lights and approached me while I was in my car. They came up to me and asked if I was okay and I explained to them I had struck a curb and got a flat tire and waited for road side assistance. They also noted my eyes were droopy. At which they asked me to step out of the car and investigated me for DUI for which they arrested me for DUI drugs after I failed the field sobriety test. Do I have a case here where I can have evidence suppressed based on lack of probable cause to detain me?
Possibly. Consult with a local experienced criminal defense attorney and give the attorney all the details of the stop and investigation. The attorney should be able to tell you what your options are.
