i recieved my first dui in may 2011. as of now ive complied with all the requirements of my court supervision.Except one that is. my court fines. i cannot get my license back until i pay the fine which ispretty high so im saving. as of now my license is valid and my driving privaleges are fully restored( i called the Sec of State license line). i have 2 questions. what happens if a cop pulls me over, will i get a ticket for not having a license on me even though my license is valid? also, if a cop scans my license plate, will it show my vehicle was involved in a DUI last year will they automatically pull me over?MY LICENSE IS NOT SUSPENDED, I JUST DONT HAVE IT UNTIL I PAY MY COURT FINES/MY PRIVALAEGES ARE VALID
In the state of NY your license is suspended until you pay your court fines, even in a non criminal conviction.
If you are driving on a suspended license, you could be arrested and charged with a misdemeanor.
Don't gamble with this one.
Call a local attorney, (or the one who handled your DUI) and make sure you can drive.
This is not legal advice. If order to give you legal advice i would need to see the Tickets and talk to the court first. Good luck:)
You will face 30 days in jail, as your license is not valid related to DUI. Yes your license plates say stop me I am stupid for driving. The cop will know right away. You will also receive a one year additional suspension. Do not drive!

Please do not listen to a NY lawyer or an Illinois family law attorney! You called the automated line, they told you your license is valid and your privileges are restored, so I assume you paid the reinstatement fee (250 or 500) or the SSS was rescinded. You cannot get your license back until you pay your fines. This is an ongoing problem for which the SOS has no definitive answer. I would suggest you drive on your DUI ticket. No I doubt the cop will run your plates and investigate any further since running your plates will show you are valid and that will be the end of it.
The worse that would happen if you were stopped is you would get a ticket for driving without your license on your person, a petty offense. You could go to court and explain to the judge why it was not on your person, good chance it would be dropped.
An option it to motion up your case, ask the judge to order return of your license upon posting an additional $300 bail. The reason your license gets held in the first place is that it stands in lieu of $300 bail.
Mr. Havartin is absoluely right and a foremost authority on Secretary of State issues. Your driving privileges appear to be valid, especially if the Sec. of State says they are. When you pay the fines, then you get your physical license back, or when you post the required bond. Another thing to think about is that down the road, if you don't pay all fines and costs, your license could be resuspended so do all you can to pay the fines when due.
