My dad rented a storage shed and put me secondary on the lease since some of my stuff was in there. My dad recently passed away and the owner of the storage facility has loced us out claiming that we need to provide a power of attorney. Dont I have rights since i am the secondary name on the lease to that stuff? Can the owner do that? What should i do?
First of all, if you are on the lease as a co-tenant, then you should have full access to the unit. Second, a Power of Attorney, even if your dad had one, terminates upon death. So the owner is just wrong. Maybe he means some sort of probate order. I would recommend you consult with an attorney who can review the lease and advise you whether you have full access rights. If so, perhaps a letter from an attorney might do the trick. I see that you are in Winter Haven. I have an office in Seminole County and one in Lake County. Please feel free to give me a call.
