Today is the last date to respond to the RFE ( 87 days after the RFE was issued to a I-129 COE petition filed in the Texas center ). My employer hasn’t responded to the RFE yet it's already 7:30PM ET, they will be responding tomorrow. Will USCIS deny the case due to missed deadline ?
Yes, they might deny the case. PLUS, if you are using the letters COE to mean Change of Employer ... this can be a larger problem.

It is possible that USCIS could deny the response to the RFE. You should speak with the attorneys for your employer to find out about the status of the response.
