I just found out that my O-1A to B2 filed in December 2015 was approved. The dates I requested were Dec 2015 to March 2016. The COS was approved 2 days back, I don't have the receipt yet (case was transferred to California Service Center and approved there) Are they likely to have back-dated the COS from Dec to March or is it like to be approved April 18th onwards for 30 days/6 months? I was in status when I applied for the COS. I realize that if it's backdated I would have to leave the country asap, which is not a problem - if I accept an offer I have I can return on a new O visa. Any insights? Thank You!
USCIS will grant the change of status to the date that you requested in the FORM I-539. In your case, you may have to depart the U.S. if the approved status ended in March 2016.
If you have a new offer to extend or renew your O visa, you should pursue that as soon as possible. If your prospective new O employment is similar enough to your last employment, it is a fairly smooth path forward (unlike the difficulties of getting your initial O-1A approved). Make sure you have a copy of your previous petition and your prospective offer and then approach an attorney about returning to your O-1A status. If you proceed quickly, you can stay in the U.S. while you wait, just as you did for the COS.
You should be ok.
You should leave the USA as soon as you can and apply for the O-1 visa from abroad.
