In NJ the age of consent is 16. However the statute 2C:14-2 (c)(4) makes it a crime if the person is at least 13 and less than 16 and the other person is at least 4 years older. There are other factors making consentual acts a crime based on the nature of your relationship to the other person. But based on age alone it is not a crime under the facts you post. That does not mean it is advisable it just means it is not criminal. if you are wrong about her age or if she misleads you about her age you are committing a crime and that is not a defense. Maybe you should rethink the issue.
