I had a lapse of consciousness 9/10 that was reported to the CA DMV from my M.D. I returned the medical eval. from my M.D. quickly & received no other communication from the DMV. I found out 13 mos.later,(1/27/12), my driver's license was suspended as of 1/5/11 only because my Ins. co. ran a ck on my driving record. I never received a letter for a driving test supposedly sent by the DMV dated 11/20/10 or a letter notifying me my driver's license was suspended. My driver's license has been reinstated but they will not remove the suspension from my record. How can I get the suspension off my record? I've had no accidents, tickets or other lapses of consciousness.
You probably at some point received a notice of intent to suspend. I doubt the DMV is required to followup to let you know that your license is in fact suspended. I would agree with Attorney Hudson that you likely have no legal basis to have the suspension removed from your record since your license was in fact suspended.
You might discuss with a traffic attorney. However, the license was in fact suspended for a period of time. I doubt you have any legal basis to have the fact of the suspension removed.
