I provide for my 6 year old on my own, his dad and I split up when he was less than a year old. He lives in another state and I am about to start the process of getting a custody order because I'm engaged and my fiance wants to adopt him once we are married. My question is, if I go to court to get full custody before starting the step parent adoption will his biological father be responsible for the past 6 years of child support? And will he have to "approve" the step parent adoption?
Typically, it does not waive any owed support, but does end ongoing support. As his rights would be terminated his consent is required, or you will have to proceed with a termination.
